WHO WE ARE

The Association of People Feeling Wronged by CT Budowlana was founded in October 2007 in order to defend a group of inhabitants of Kryształowe district in Gdańsk in Aleksandry Gabrysiak Street who were cheated by the dishonest property developer. We were cheated because we paid 100 % of the apartment price in 2001 and we haven’t received the notary deeds up to now.

CRY FOR JUSTICE

to the decision makers, politicians and most of all to the bankruptcy commissioner judge and the bankruptcy trustee to notice the moral and human aspect of this matter, to notice us Polish citizens who paid for our long dreamed of apartments and who want the apartments to be our property. How can you in the name of law turn pregnant women, elderly people or people with kids into the street or garbage cans. Our fate lies within the Courts competence and depends on its good will to which we appeal. There is jurisdiction, also by the Supreme Court and there is a legal way to give us property rights to our apartments.

The situation is becoming more and more desperate!!!

In spite of our multiple attempts to come to agreement with the Court, all of our propositions have been rejected, although we wanted to pay extra substantial amounts of money.

At this moment the bankruptcy trustee with the consent of the commissioner judge has begun to terminate our agreements with the developer in order to put up to auction and sell our apartments.

The auction will not be public, which reduces our chances of defending our apartments.

We are afraid that it is an attempt to sell our apartments with us behind our backs.

Therefore we ask for help– any help- legal, advisory, financial in solving this ordeal.

Isn’t there in the centre of Europe, in the European Union ANYBODY who could HELP us???!!!

OUR STORY

We found ourselves in such hopeless situation not because of our fault. In 2001 we bought apartments from property developer in Gdańsk Jasień in Aleksandry Gabrysiak Street, the district called Kryształowe. We payed 100% of the apartments value and did all our duties resulting from the contract.

We did apartment commissioning, started to furnish the apartments and lived in them waiting for signing notary deeds giving us property rights. Several months later multi-million loans appeared on the land on which our apartments were standing. They were caused by the developer taking huge credits on the land. In 2003 the developer went BANKRUPT without signing notary deeds with us.

It appeared we found ourselves in a group of several dozen creditors, among them many contractors who weren’t paid for the work they did, producers and retailers of building materials, National Insurance Company, Internal Revenue and others. Unfortunately according to the Polish law we are appointed to the last group of creditors having the right to claim.

For many months we have tried unsuccessfully to achieve the property rights. We have even proposed to reach agreement with the bankruptcy trustee and commissioner judge proposing additional payment for apartments already 100% paid for.

Our multiply renewed attempts to negotiate agreement with Court were all rejected, although we wanted to pay additional considerable amounts of money. At this moment the trustee with the consent of commissioner judge has started to renounce our sales contracts with the developer in order to arrange auction and sell our apartments. The auction will not be public which will reduce our chances of defending our apartments. We are afraid that behind our backs he wants to sell the apartments with us. We want to ask for help in solving this desperate situation. Maybe you know of a way to solve the drama of nearly a hundred people.

In spite of all this we have not given up and we are going to fight for our apartments using all possible ways, they are our apartments, we have paid large amounts of money for them, for most of us it was the achievement of our life.

That is why this website was set up, we ask for any possible help. We will be grateful for dealing with this matter – which will surely help you, your families and friends to avoid such trouble in future.
